    Well guys,
    In a shit way at the minute.

    Coming back from mates last night at quarter past twelve. On the same road i use most days.
    Decided to open the golf up a bit looking ahead for police.

    Next thing i no past a T5 sitting behind a set of tress :( :(

    Came straight after me.

    Clocked me doin 130mph on his speed gun!!!

    Have to go to court in few weeks time

    Any one on here been through this? little help would be great.

    Very pissed off and upset.

    Does anyone no how long the ban would be for?

    I asked the coppa and he says 1 month?!

    Would be grateful for some help guys

    Bad luck :( My worst was 105mph but managed to just get a small fine and 3 pts.... there are some web sites that give advice, maybe worth a google

    What was the speed limit of the road you were on...if it was a 70 you lookin at between 7 day and 56 day ban and a hefty fine.

    I have been caught speeding at more than 100 mph on the motorway. Is a ban automatic?

    Although the Police attempt to resolve most offences by way of a Fixed Penalty Notice, at excessive speeds, a Court appearance is inevitable. As a general rule of thumb, for speeds in excess of 100 mph (or more than 30 miles above the relevant limit) the punishment starts at disqualification as opposed to penalty points. However, the decision is at the discretion of the Court and in certain circumstances, a disqualification can be avoided.
    Say you got cramp and your foot got stuck on the accelerator!

    Sorry to hear this mate. I was in my corsa once and thought "what does it matter if I speed a bit I'll always see a copper0 Littally that night I chased an old banger off a roundabout when I looked in my mirror and mr policeman is behind........ DOH!!!!

    Luckally I managed to talk my way out of it. Very rarly open up the R so I'm speeding to excess. I just boot it up to the speed limit.

    Don't get upset mate, it's not worth letting it get you down.

    Just accept that you got caught. Hope the outcome isn't too bad.

    Keep your fingers crossed that it remains simply speeding, and steel yourself for a two month ban. If you already have points on your licence, it could be longer. Worst case scenario, someone decides that you should be charged with dangerous driving instead (12 months ban).

    And I thought that *I* was having a bad day.
    I was car-jacked for my first MkV R32 (fantastic car, DCG with factory sat nav and leather Recaros; excellent car, properly looked after and never gave me a moment's trouble. I hope the bugger who nicked it dies horribly).
    So I went out and bought another (leather seats, rather than Recaros, and it's not as good as the old one, but it is an R32).

    It's not really bad luck is it, it's a little bit silly to be nearly double the speed limit on a public road.

    As above, you're looking at somewhere between a short and a lenghty ban. Just to put it into perspective as to how lucky you are people have received jail terms for only 20mph faster.

    I am not stating you should be religious with regards to speed limits, but if you missed a brightly marked T5 due to trees then you could equally have missed a non-brightly coloured truck about to pull out and then a small driving ban would be the least of your worries!

    Drive with the appropriate speed and consult a good traffic solicitor to prepare your case as they are well worth the money

    I wouldn't get too worked up m8 whats done is done.

    Best thing get a good lawyer who deals with such stuff. That can make the best difference in my opinion. If you need the car for your job then that may help your case (or at least lesson the penalty).

    Every case is different and you, me or anyone else won't be able to predict the outcome.

    Dito......i love fast cars and not puttin the boot in. Im sure your gutted. But 130MPH?? Lifes one big learning curve.

    A good number to bear in mind is "speed limit +30mph" - if you drive faster than the limit, you're going to accumulate points and fines; but if you drive *above* the limit +30mph, life can get very uncomfortable if and when you're caught.

    get yourself your company/squadron 2ic to plead your case! Few of my mates have been in situation and have been squared away. If you have just come off tour, play that card to your advantage, ive heard it worked!!

    Depends on what the magistrate/judge orders. Can be made to take an extended retest iirc.

    Possibly... If you are banned and the ban lasts less than 56 days then you can have your license reinstated. Your license can be reinstated providing there is no further court intervention. It has been known for the court to ask for the individual to retake their driving test before their license is returned. If the ban does exceed 56 days then you should assume that you will be returned to provisional license status and will have to take the driving test and theory tests again.

    However, I am not sure if this is just since the new drivers act was established in 1995 or if the rules are different for licenses issued prior to this date.

    There are two types of ban - discretionary, where the court could have given you points instead but decided that you were too naughty (such as with speeding), and mandatory (where the court has no choice but to ban you, for offences like drink-driving).

    If you clock up 12 or more points, you get a 6month minimum mandatory ban under the "totting up" rules.

    Any type of ban can be argued against if the court accepts you would suffer "exceptional hardship".

    Any type of hearing that could result in a ban ought to be handled by a lawyer acting on your behalf, BTW. I've seen a lot of people make matters worse - or at least no better - when for a few hundred quid they could have walked away with a much better result.

    If you're banned for longer than 56 days, when your licence comes back, it's clean of points. If you're banned for less than 56 days, whatever points you had stay on it. Points remain on the licence and "effective" for 3 years. Either way, the licence comes back when you ask for it - you don't have to take your test again. The exception is for newly-qualified drivers - they have only 6 points to play with, and if they get 6 or more the licence is taken away without any court hearing and they have to take the test again. For fully-qualified drivers, a retest is only required for *some* offences (such as dangerous driving), but *not* for others (like speeding).

    I'm pretty sure that all of the above is correct; it's part of my job to know it, but there are so many twiddly bits it always pays to get someone to check things over properly rather than take the word of strangers on the internet.

    Sorry to here that mate, I got caught a fue years back doing 123 mph on the a21 in kent. i had to go to court and was told i was looking a 12mth ban? i got in touch with a solicitor who advised me to go to court with a barrester, he managed by saying i need my licence for work so no licence no job, result was 60day ban and £800 fine but no points and £1000 solicitors fee.

    a mate of mine was caught doing the same speed and he was on 9 points.....got a 600 quid fine as wt007 says a good solicitor works wonders (will not work forever though so curb it)

    I recently just got my licence back...

    I got caught doing 120mph on a motorway. Was followed for a while by an unmarked so had no idea. I went to court and came home with a 4 month ban and about £500 fine inc. court costs.

    Licence came back clean (old points gone) and I was given an SP50 (Exceeding 70mph on a motorway). Didn't have to re-take the test or anything like that.
